Every Personal Injury Lawyer in Ohio Should Be Upset

Every personal injury lawyer in Ohio has to be a little upset today. The Ohio Supreme Court voted and on a 5 to 2 basis upheld the caps on damages for personal injury lawsuits. Earlier in 2004 the state legislature passed a law capping jury awards for pain and suffering, mental anguish and other non-economic damages to $350,000. This is applied unless the injured person loses a limb of organ.

This law was passed because of the case of Melisa Arbino vs. Johnson & Johnson. In this case Melisa was suing because she had suffered blood clots and several other medical problems after using Johnson & Johnson's birth control patch.

Both Justices Paul E. Pfeifer and Terrance O'Donnell disagreed with the ruling and wrote dissenting opinions.

Justices Pfeifer stated that caps were unconstitutional because they took away the benefit of a jury trail for the injured.

O'Donnell said the cap on pain and suffering awards "substitutes the judgment of the General Assembly for that of a jury."

If you are a Florida Lawyer watch out!

If you are a Florida lawyer, you better be on best behavior. The State bar has been busy cleaning house. In an article from the Tampa Bay Business Journal, they reported that: "The Florida Bar disciplined 23 attorneys, disbarring three, suspending 14, placing three on probation, reprimanding six and ordering three to pay restitution, including six lawyers from Tampa Bay."

Some of the Florida lawyers and their infractions were listed in the article. Here are some excerpts from that article as they appeared in the paper:

"Laureen Adele Cameron of Sarasota will receive a public reprimand from the Florida Bar Board of Governors. She was placed on probation for two years effective immediately and directed to complete Bar's trust accounting workshop, following a Nov. 21 court order, a Bar release said. Cameron allegedly failed to diligently and competently represent and communicate with a client who was seeking repayment of a loan in one case and attempting to set aside a judgment from an insurance company in another."

"Kevin Alan Fuller of Hudson was reprimanded and directed to attend Ethics School, following a Nov. 21 court order. Fuller allegedly failed to competently represent a client by not taking the necessary steps to enforce a company's Claim of Lien, resulting in the lien expiring."

"Peter William Martin of Sarasota was suspended for three years, effective retroactively to Sept. 7, 2006, and ordered to pay restitution totaling $29,990 to two clients, following a Nov. 21 order."

"Martin Kirby Watson of St. Petersburg was disbarred, effective 30 days from a Nov. 1 order. He agreed to make reasonable efforts to reimburse the Clients Security Fund of the Florida Bar if payments are made as a result of his conduct."

"Alan D. Watson of St. Petersburg was suspended for 15 days effective 30 days from a Nov. 15 order and ordered to attend Ethics School."

Former Houston Lawyer Shot by both of His Wives!

Jim Tatum, a Colorado lawyer, was gunned down in his kitchen last week as witnessed by a county deputy. Ann Tatum was the current wife of Jim Tatum, and she is the one who has been charged with second-degree murder for his death. The news of Jim Tatum's death did not take long to travel to Houston, Texas. Jim Tatum was a prominent Houston Lawyer in the 1980's famous for wearing cowboy boots to court. The lawyer who represented the first Mrs. Tatum in her divorce from the deceased stated that his client Elizabeth Tatum also shot the deceased while they were still married. Elizabeth Tatum did in fact shoot her then husband, Jim Tatum in the arm with a .22 one night while he was physically abusing her. No charges were ever filed against the first Mrs. Tatum
